FOODSTUFFS FOR PARTICULAR NUTRITIONAL USES

Foodstuffs for particular nutritional uses are foodstuffs which significantly differ from usual foodstuffs due to their specific composition or production method and which are suitable due to their claimed nutritional purposes and are marketed in a way that states this suitability.

Particular nutritional use must comply with the particular nutritional requirements:
- of certain groups of persons with digestive or metabolic disorders,
- of certain groups of persons whose physiological condition requires controlled and directed nutrition,
- of healthy babies and infants.

Legislation on foodstuffs for particular nutritional uses is harmonised in the EU. The national regulation governing this field is the Rules on foodstuffs intended for particular nutritional uses (Official Gazette of the Republic of Slovenia, No 46/02, 117/02, 41/04, 65/06 , 57/07 and 22/10).

Appendix I of these Rules lists the groups of foodstuffs for particular nutritional uses to which specific regulations apply, which
include:
- infant formulae and follow-on formulae for infants and small children,
- processed cereal-based foods and baby foods for infants and small children,
- foods intended for use in energy-restricted diets,
- foods for special medical purposes,
- gluten-free foods,
- foods for athletes’ nutrition,
- foods with low sodium or salt content.

Foodstuffs for particular nutritional uses that are not in any of the groups listed in Appendix I to the Rules on foodstuffs intended for particular nutritional uses and infant formulae must be notified at the Ministry of Health prior to their first placement on the market in the Republic of Slovenia.

The notification of foodstuffs for particular nutritional uses:

notification is made according to Article 10 of the Rules on foodstuffs intended for particular nutritional uses.
An administrative fee of EUR 14.18 is to be paid for notification. According to the Administrative Fees Act (Official Gazette of the Republic of Slovenia, No 8/00, 44/00, 81/00, 31/01, 42/02, 18/04, 91/05, 131/06, 5/07, 14/07 and 126/07), administrative fees may be paid in cash, electronically or by other means of payment to account no: 01100 - 1000315637, reference: 11 27111-7111002; notification of foodstuffs for particular nutritional uses.
